First of all, do you know what is an ordinance?

The President has the power to issue ordinances on the advice of the Union Cabinet. This ordinance is as powerful as the law passed by the Parliament. There is a condition attached to the ordinance. It is necessary to pass the ordinance within six months of its promulgation by the Parliament. This is the reason that the Center will have to bring the Delhi Ordinance in this session because the winter session will be held in November-December, by which time its deadline will be over.

A law made through an ordinance can be withdrawn at any time. Through an ordinance, the government cannot enact any such law, which takes away the fundamental rights of the people.

What is Delhi Ordinance?
A five-judge constitution bench headed by Chief Justice DY Chandrachud, while giving its verdict on May 11, said that except for land, police and law and order in Delhi, the government of Delhi will be free to take all other administrative decisions. Will also be able to do transfer-posting of officers and employees.

Except for these three issues, the Lieutenant Governor is bound to accept the rest of the decisions of the Delhi government. The Constitution Bench headed by Chief Justice DY Chandrachud gave a unanimous verdict in this matter. Prior to the apex court’s May 11 verdict, the transfers and postings of all officers of the Delhi government were under the executive control of the Lieutenant Governor.

However, a week after the court’s decision, on May 19, the central government brought an ordinance. By bringing the ‘Government of National Capital Territory of Delhi Ordinance, 2023’, the center gave back the right to appoint and transfer administrative officers to the Lieutenant Governor. The National Capital Civil Services Authority has been constituted under this ordinance. The Chief Minister of Delhi, the Chief Secretary of Delhi and the Home Secretary have been made its members. The Chief Minister will be the chairman of this authority and on the basis of majority, this authority will take decisions. However, in case of difference of opinion among the members of the authority, the decision of the Lieutenant Governor of Delhi will be considered final.

Why did the central government bring the ordinance?
The verdict given by the Supreme Court in the case of transfer-posting of officers in Delhi was in favor of the Kejriwal government. In such a situation, it was possible to reverse it only by amending the law or making a new law. The Parliament was not functioning at that time, in such a situation, the central government overturned this law by bringing an ordinance. Now it is necessary to pass this ordinance in both the Houses of the Parliament within six months.

Why did the matter reach the court?
The AAP government of Delhi again moved the Supreme Court against this ordinance. The Delhi government has told against the order of the Supreme Court of this ordinance. You say that the central government has brought this ordinance to take away the powers of an elected government. And on July 21, the court referred the matter to a five-judge constitution bench. The CJI said that the constitution bench will consider making such amendments.

What is happening now regarding this?
Union Law and Justice Minister Arjun Ram Meghwal told that the bill to replace the Delhi Ordinance will be introduced in the Lok Sabha next week. Along with the protest in the court, the Aam Aadmi Party is also gathering the support of various opposition parties on this issue. Many opposition parties including Congress have announced to oppose the ordinance.

Will the bill pass in Parliament?
The BJP has a majority in the Lok Sabha, so the Delhi ordinance will be easily passed here. At the same time, despite not having a majority in the Rajya Sabha, it will not be difficult for the Central Government to get the bill passed in the Upper House. The Center is in a good position to get the bill passed given the current strength of MPs in the Rajya Sabha, but much will depend on regional parties such as Naveen Patnaik’s Biju Janata Dal (BJD) and Jagan Reddy’s YSR Congress Party. Meanwhile, on Wednesday the YSR Congress Party announced its support to the Center on the Delhi Ordinance. Party leader V Vijaysai Reddy told that his party will support the government on the issue of Delhi ordinance. Party MPs have also been informed about this. The Biju Janata Dal with nine MPs can also support the NDA government. However, Naveen Patnaik has not yet clarified his stand.

What is the number math in Rajya Sabha?
Talking about the strength in the Rajya Sabha, the current strength is 238 due to seven vacancies in the 245-member House. At present, the number of BJP MPs in the Upper House is 93. According to the numerical strength, the state
