BJP MLA Suvendu Adhikari has approached the Supreme Court. He has reached the top court in the case of provocative remarks. The Calcutta High Court had directed registration of an FIR against him for allegedly making inflammatory remarks during the recent panchayat elections in Bengal.

On July 20, the High Court had ordered registration of an FIR against the BJP leader. The case is related to allegedly giving inflammatory speech during Panchayat elections. Advocate Bansuri Swaraj, appearing for the officer in the apex court, mentioned the matter before a bench headed by Justice Sanjay Kishan Kaul, who said that the matter would be heard on the predetermined date of August 4 only. The court rejected the appeal of the petitioner for hearing on 31 July.

Swaraj said that the July 20 order of the High Court was against the previous order of the Supreme Court and the order of the coordinate bench of the High Court to stay the FIR against the petitioner. He said, with the order of the High Court, many FIRs can be registered against the officer. An FIR has already been registered against him even after he filed a Special Leave Petition on 24 July. The counsel also submitted that the order of the High Court has been passed on the basis of a PIL without giving any opportunity of being heard to the petitioner.

Significantly, the Calcutta High Court had recently given a blow to BJP leader Suvendu Adhikari in West Bengal. The court had ordered that henceforth the Calcutta police can register an FIR against Leader of Opposition Suvendu Adhikari in any valid case. The court had said that if the police have the right information then a case can be registered. Police can take action as per law. A division bench of the Calcutta High Court set aside an earlier order by Justice Rajasekhar Mantha, which granted protection to Suvendu Adhikari from FIRs by the police in West Bengal since last December.
