Congress leader Rahul Gandhi told the Supreme Court that he has always maintained that he is not guilty of the crime and conviction is not sustainable. The former MP also said that if he had to apologize and mitigate the crime, he would have done so long ago.

Rahul Gandhi has said in his affidavit that complainant Gujarat BJP MLA Purnesh Ishwarbhai Modi used derogatory words like ‘arrogant’ to describe him in his reply before the Supreme Court only because he refused to apologise. .

The affidavit states that using criminal procedure and consequences under the Representation of the People Act to compel Rahul Gandhi to apologize for no fault of his, is a gross abuse of judicial process and should not be accepted by this court.

It states that he has an ‘extraordinary’ case considering the offense as a minor offense and the irreparable damage caused to him as an elected MP… On the other hand, there is no prejudice to the complainant. Therefore, it is prayed that the conviction of Rahul Gandhi may be stayed, so that he may participate in the ongoing sittings of the Lok Sabha and subsequent sessions.
